- The 48-Hour Rule: Under most state Shops and Establishments Acts, the standard workweek is 48 hours. Anything beyond this is legally classified as overtime.
- Double Compensation: The law is clear — overtime work must be compensated at twice (2x) your regular hourly wage.
- The "Manager" Myth: Companies often give employees titles like "Team Lead" or "Assistant Manager" to claim exemption from OT laws. However, the law looks at your actual duties, not just your title. If you are doing core operational work, you are likely protected.

Managers often tell employees that if they cannot finish their work in 9 hours, they are "inefficient," forcing them to work late for free to "prove their worth."
Promising a "Compensatory Off" instead of pay, only to deny the leave later due to "project exigencies."
Using state-level exemptions for the IT sector to ignore standard working hour protections entirely.
The Tide is Turning: Unions & Government Action

Organizations like NITES (Nascent Information Technology Employees Senate) and KITU (Karnataka State IT/ITeS Employees Union) have been aggressively filing petitions against major tech giants for forced 14-hour workdays and unpaid labour. FITE (Forum for IT Employees) actively challenges corporate giants on issues of working hours, harassment, and wrongful termination.
- Labour Ministry Notices: Following tragic incidents of workplace stress, the Ministry of Labour has begun issuing stricter notices to firms regarding employee well-being and shift timings.
- The OSH Code: The upcoming Occupational Safety, Health and Working Conditions Code aims to centralise these protections, making it harder for companies to hide behind state-level loopholes.
- Right to Disconnect: Private Member Bills have been introduced in Parliament advocating for the "Right to Disconnect," legally protecting employees who refuse work communications after hours.

- Maintain Evidence: Save screenshots of your login/logout times, emails sent late at night, and WhatsApp messages from managers demanding work on holidays.
